Kearns & West in Action:
Mobilizing Messages and Support on Regulatory Change |

Situation
A communications company came to K&W because
it was threatened with a regulatory change that would both shut down
an important revenue source and undermine its initial public offering.
The problem: a larger company sought to convince regulators to allow
it to off-load its costs onto smaller competitors, which would have
led to higher bills for Internet users.
Approach
In one month, Kearns & West organized and mobilized key stakeholders
to advocate in their own interests. Those stakeholders were primarily
the many Internet Service Providers (ISPs) that compete with the big
guys, and the customers of those ISPs.
The program created an unmistakable groundswell against the proposal
by simply informing impacted groups of the potential decision. We
did so in ways that were designed to reinforce each other, create
momentum, and bring authentic voices and facts into the policy discussion.
The program included:
- Mobilizing ISPs to meet with state regulators, state legislators
and local opinion leaders. The meetings led to more than a dozen
state legislators expressing concern.
- Distributing an action alert to ISPs, which generated thousands of
personal and unique e-mails from their customers to policy
makers.
- Placing articles, editorials and opinion editorials in
every major newspaper in the state.
- Identifying the need to engage a lobbyist and assisting our
client select a well-qualified lobbying firm.
Results
The proposal was successfully defeated at the state level—preserving
a critical revenue source for our client. With the regulatory risk
mitigated, Kearns & West’s client was able to proceed with
a successful IPO.
